These terms cover your use of the Hi, How Are You? app ("the app"), run by Hi How Are You Foundation Inc. By creating an account you agree to them. If you do not agree, please do not use the app.

What the app is, and what it is not

Hi, How Are You? is a wellness app. It gives you a place to journal, track your mood, build habits, and take part in a community around the Six Happy Habits.

The app is not medical care. It is not therapy, it is not counselling, and it does not diagnose or treat anything. Nothing in the app is medical advice, and it is not a substitute for a doctor or a mental health professional. Do not delay getting professional help because of something you read here.

The app is not an emergency service. Nobody is watching your journal or the community wall for signs that you are in danger. If you are in crisis, call or text 988 (the Suicide and Crisis Lifeline in the US), or your local emergency number.

Your account

You sign in with your email address, and we send you a link rather than asking for a password. That means anyone who can read your email can sign in as you, so keep that account secure. Tell us at info@hihowareyou.org if you think someone else has got into your account.

You must be 18 or older to use the app.

You are responsible for what happens on your account.

Community rules

The community wall and support circles only work if people feel safe there. When you post, do not:

  • Harass, bully, threaten or abuse anyone.

  • Post hate speech, or attack people over race, religion, disability, gender, sexual orientation or any similar characteristic.

  • Encourage self harm, suicide, or disordered eating, or share methods for any of them.

  • Share someone else's private information.

  • Post sexual content, or anything sexual involving minors.

  • Spam, advertise, or run scams.

  • Impersonate someone else, including our staff.

  • Break the law.

We can remove any post and suspend or close any account that breaks these rules. Serious cases, particularly anything involving a threat to someone's safety, may be reported to the authorities.

Posting anonymously hides your name from other users. It does not make you unaccountable to us, and these rules still apply.

Your content

What you write stays yours. You give us permission to store and display it only as far as we need to in order to run the app, which for journal entries means showing them back to you, and for community posts means showing them to other users.

We can remove content that breaks these terms.

Ambassadors

If you join the ambassador program, you take on some extra responsibility. You represent Hi, How Are You? when you host events, so run them safely and lawfully, describe them accurately, and keep any commitments you make to people who show up. We can remove ambassador status at any time.

If you fundraise, do it through the campaign tools we provide. Donations are handled by Givebutter under their own terms, and we do not take or hold donor payments ourselves.

Deleting your account

You can delete your account at any time from your profile. Details of what gets deleted are in the privacy policy. We can also close an account that breaks these terms.

The app is provided as is

We work to keep the app running well, but we cannot promise it will always be available, error free, or that anything in it will produce a particular result for your wellbeing. To the extent the law allows, we provide the app without warranties.

Limits on our liability

To the extent the law allows, we are not liable for indirect or consequential losses arising from your use of the app. Nothing in these terms limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence.

Changes to these terms

We may update these terms. If a change meaningfully affects you, we will tell you in the app or by email before it takes effect. Carrying on using the app after that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Texas and the United States. Disputes will be handled in the state or federal courts located in Travis County, Texas.
